Terms and Conditions

Last updated: 15 October 2026

These terms apply to use of firstgeardriving.com.au and provide general information about booking driving instruction with First Gear Driving School (“First Gear”, “we”, “us” or “our”). Read the specific service description and any booking terms supplied before you confirm or pay for a lesson. These general terms do not replace your rights under Australian Consumer Law.

1. Website use

You may use this website for lawful personal enquiries and bookings. Do not interfere with its security, attempt unauthorised access, submit malicious material or use it to mislead others. We aim to keep information accurate, but please confirm details relevant to your booking directly with us if anything is unclear or appears inconsistent.

2. Bookings and service areas

Lessons are subject to instructor availability, an appropriate vehicle, an agreed pickup location and the instructor’s service area. Provide accurate contact and booking details and check your confirmation carefully. If you are unsure whether we cover your suburb, contact us before paying. A booking request is subject to confirmation through the booking service or directly by First Gear.

If a booking cannot be provided as agreed, we will contact you to discuss a suitable alternative or any refund or other remedy to which you are entitled.

3. Prices and payments

The price, lesson duration, inclusions and payment requirements for your selected service should be provided before you book. Confirm whether a package includes test fees, use of an instructor vehicle or other extras. Any package expiry, transfer restrictions or additional charges must be disclosed before purchase; do not assume these apply if they have not been provided. Agreed bookings are not retrospectively repriced without your agreement.

Government licence and driving test fees are separate unless expressly included in your booking. Where a third-party payment service is used, its payment processing terms also apply, subject to your statutory rights.

4. Cancellations, rescheduling and refunds

Contact us or use the booking service as soon as you need to change or cancel a lesson. Any cancellation notice period, late cancellation charge or missed lesson fee must be disclosed before you confirm the booking. This page does not set a fixed cancellation deadline or fee. If no policy has been supplied, ask us to confirm it before you book.

Refund requests will be assessed against the terms disclosed at booking, the circumstances and Australian Consumer Law. A cancellation policy does not remove rights to a refund or another remedy where the law provides one. If we need to cancel or substantially change a lesson, we will discuss rescheduling or the applicable refund or remedy with you.

5. Learner responsibilities and safety

You must hold the licence or learner permit legally required for the lesson, carry it when required, and comply with applicable licence conditions and road rules. Tell the instructor about relevant restrictions, accessibility needs or safety matters before the lesson. Attend fit to drive, and do not attend affected by alcohol, illegal drugs or medication that makes driving unsafe.

Follow reasonable safety instructions and treat instructors and vehicles respectfully. An instructor may delay, change or stop a lesson where continuing would be unsafe or unlawful. Any payment or refund implications will be considered fairly under the disclosed booking terms and applicable law.

Where a parent or guardian arranges or pays for lessons, please ensure the learner understands the booking and safety requirements. Any consent legally required for a learner must be obtained before the relevant activity.

6. Lesson progress and driving tests

Lessons are tailored to the learner’s experience and progress. The number of lessons needed varies. We cannot guarantee a particular test result, a pass on the first attempt or a specific timeframe for obtaining a licence. The relevant licensing authority controls test availability and results.

Use of an instructor vehicle for a test requires a confirmed booking and agreement that the arrangement can be provided safely and lawfully. Check the package inclusions and requirements with us before booking your test.

7. Reviews, photographs and testimonials

Google review cards display a selected sample of recent five-star reviews rather than all reviews. The overall rating and review count relate to the Google Business Profile and may be temporarily cached. Use the Google link to view the wider review listing. Individual reviews and student success stories describe individual experiences and do not guarantee similar outcomes.

Student photographs and promotional stories are subject to permission. Contact us to request correction or removal from channels we control. See our Privacy Policy for more information.

8. Google account connection

The First Gear Website Reviews application is an administrative tool for connecting an authorised business account and retrieving review information for this website. Only a person authorised to manage the relevant Business Profile should connect it. The application does not require website visitors to provide Google credentials and does not claim endorsement or partnership with Google. Authorisation and disconnection are explained in our Privacy Policy.

9. Intellectual property and third-party links

Website text, photographs, branding and other material are owned by First Gear or used with permission, except where identified otherwise. You may view the website for personal use. Obtain permission before reusing protected material beyond what the law allows. Google reviews, third-party trademarks and externally linked material remain subject to their respective rights.

Links and embedded services may take you to third-party websites with their own terms and privacy practices. Check relevant details before making a transaction or supplying information. We remain responsible for obligations that apply to our own services.

10. Consumer rights

Services supplied to consumers are subject to guarantees under Australian Consumer Law, including applicable guarantees about due care and skill and fitness for an agreed purpose. Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded, restricted or modified. Where a service fails to meet an applicable guarantee, the remedies required by law remain available.

11. Questions, complaints and governing law

If you have a concern about a lesson, payment or this website, contact us with your booking details and a description of the issue so we can investigate and work towards a fair resolution.
